1. Introduction and Acceptance of Terms

Welcome to YouthTyping. By downloading, installing, accessing, or utilizing the YouthTyping software applications (including our desktop client for Windows, mobile applications for Android, and any future supported platforms), our website, APIs, databases, and associated web services (collectively, the "Service" or "Platform"), you are entering into a binding legal agreement with YouthTyping ("we", "us", or "our").

These Terms and Conditions ("Terms") govern your access to and use of the Service. Please read these Terms carefully before utilizing our platform. By clicking "I Accept", completing the registration process, or merely browsing our website and using our software, you signify your irrevocable acceptance of these Terms. If you do not agree to these Terms in their entirety, you must immediately discontinue your use of the Service, delete any installed software from your devices, and destroy all copies in your possession.

2. Description of the Service

YouthTyping is a comprehensive, multi-platform educational software suite designed specifically to train users in typing proficiency, with a particular focus on preparing candidates for Indian government examinations, including but not limited to the Staff Selection Commission (SSC) CHSL, CGL, State High Courts, CRPF, Railway NTPC, and various Lower Division Clerk (LDC) tests.

The Service provides simulated exam environments, extensive lessons for English and Hindi typing (including native support for Mangal Font, Remington Gail, Inscript, and Kruti Dev), detailed real-time analytics, Gross and Net Words Per Minute (WPM) calculations, error highlighting, and historical progress tracking. The Service is offered as a downloadable desktop client supplemented by a web-based dashboard and mobile application. We reserve the right to modify, update, suspend, or discontinue any aspect of the Service at any time without prior notice or liability.

3. Definitions

  • "User", "You", "Your": Any individual or entity who accesses, downloads, or interacts with the Service.
  • "Account": The unique user profile created upon registration to access premium features of the Service.
  • "License Key": A unique alphanumeric string generated upon successful payment that unlocks premium functionalities within the software.
  • "Hardware ID": A mathematically generated unique identifier tied to the physical components of your device (e.g., Motherboard, CPU, MAC address), used to bind your License Key to a specific machine.
  • "Individual Plan": A licensing tier designed for single-user practice on a single designated device.
  • "Institutional Plan": A commercial licensing tier designed for educational institutions, cyber cafes, and typing centers, allowing multiple concurrent device activations under a master administration account.

4. Software License and Usage Rights

Subject to your continuous compliance with these Terms and the payment of any applicable subscription fees, YouthTyping grants you a limited, personal, non-exclusive, non-transferable, and revocable license to download, install, and execute the YouthTyping software on your devices.

4.1 Individual Licenses: An Individual (Student) license is strictly tied to a single user and a single hardware device. When you activate an Individual License Key on a device, our servers record the Hardware ID. You may not share this License Key with friends, family members, or colleagues, nor may you activate it concurrently on a second PC or laptop. If you purchase a new computer, you must contact our support team to request a manual Hardware ID reset, which is granted entirely at our discretion and subject to verification to prevent abuse.

4.2 Institutional Licenses: Institutional licenses are specifically engineered for commercial environments such as typing institutes. These licenses permit the software to be activated on a predefined maximum number of devices (e.g., 10, 20, or 50 concurrent seats). The institutional administrator is solely responsible for managing device access via the YouthTyping Admin Dashboard. Institutional licenses are strictly prohibited from being activated on Android or Web platforms and are exclusively meant for the Windows Desktop environment. Furthermore, institutional administrators may not sub-lease, resell, or distribute access credentials to external third parties.

4.3 Background Verification: To enforce licensing constraints, the YouthTyping software periodically communicates with our backend servers in the background. If a license is found to be expired, revoked, or utilized on an unauthorized device, the software will automatically downgrade to the free tier or restrict access without requiring an application restart. Bypassing or attempting to block this background verification is a material breach of these Terms.

5. User Accounts, Registration, and Security

To access the full suite of features, you are required to register for an Account. During the registration process, you agree to provide truthful, accurate, current, and complete information. You agree to promptly update your account details to maintain their accuracy.

You are entirely responsible for maintaining the confidentiality of your account password and your purchased License Keys. You are solely responsible for any and all activities that occur under your account. YouthTyping will not be held liable for any loss or damage arising from your failure to safeguard your credentials. If you suspect any unauthorized access to your account, you must notify us immediately. We reserve the right to temporarily suspend or permanently terminate accounts that exhibit suspicious activity, including anomalous login patterns indicative of account sharing.

6. Payment, Pricing, and Billing Policy

6.1 Fees and Taxes: YouthTyping operates on a freemium model. Basic features may be offered for free, while advanced features, extensive test libraries, and analytics require a paid subscription. All prices listed on our website are inclusive of applicable taxes unless stated otherwise.

6.2 Payment Processing: Payments are securely processed through third-party payment gateways such as Cashfree or Razorpay. By initiating a transaction, you authorize us and our third-party processors to charge your selected payment method for the total amount of your chosen subscription plan. We do not store your full credit card numbers or banking credentials on our servers.

6.3 Price Changes: We reserve the right to modify our pricing structure, introduce new fees, or change subscription tiers at any time. However, any price changes will not retroactively affect active subscriptions; the new rates will only apply upon your next renewal or subsequent purchase.

7. Cancellation and Refund Policy

Due to the instantaneous and digital nature of the YouthTyping software, all sales are considered final once a License Key has been successfully generated and issued to your account. We maintain a strict no-refund policy for "change of mind" or failure to read system requirements. Exceptions are granted only in cases of documented, critical technical failures that entirely prevent the software from operating on supported operating systems, provided our technical team cannot resolve the issue within 7 business days. 8. Intellectual Property Rights and Anti-Piracy

The YouthTyping Service—including but not limited to its underlying source code, executable binaries, user interface design, proprietary typing algorithms, test passages, analytical models, text, graphics, logos, button icons, and databases—is the exclusive property of YouthTyping and is protected by Indian and international copyright, trademark, trade secret, and intellectual property laws.

You agree that you will not:

  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the software.
  • Modify, translate, adapt, or create derivative works based on the Service.
  • Remove, alter, or obscure any copyright notices, trademarks, or proprietary rights notices embedded within the software.
  • Utilize memory editors, debuggers, or interception proxies to bypass our Hardware ID validation or license verification APIs.
  • Distribute, lease, rent, or publicly host the executable files or License Keys for unauthorized third-party consumption.
Any violation of these intellectual property rights will result in immediate termination of your license, irrevocable forfeiture of your account, and potential civil and criminal prosecution to the fullest extent permitted by law.

9. User Responsibilities and Acceptable Conduct

While using the Platform, you agree to act responsibly and ethically. You shall not use the Service for any unlawful purpose or in any manner that could damage, disable, overburden, or impair our servers or networks. You are prohibited from attempting to gain unauthorized access to any part of the Service, other accounts, or computer systems connected to our infrastructure through hacking, password mining, or any other illegitimate means. You must not upload or transmit any malicious code, viruses, worms, or trojans through our custom text upload features. Furthermore, you agree not to use automated scripts, scrapers, or bots to interact with our web applications or APIs.

10. Third-Party Services and Links

The Service may contain links to third-party websites, applications, or services that are not owned or controlled by YouthTyping. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You acknowledge and agree that YouthTyping shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

11. Disclaimers of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOUTHTYPING EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

YouthTyping makes no warranty that: (i) the Service will meet your exact requirements; (ii) the Service will be uninterrupted, timely, secure, or entirely error-free; (iii) the analytical results, WPM calculations, or progress reports obtained from the use of the Service will be perfectly accurate or perfectly mirror the scoring systems of actual government testing bodies; or (iv) the quality of any products, services, or information purchased or obtained by you through the Service will meet your expectations. We do not guarantee that practicing on our software will guarantee a passing grade or employment in any governmental or private typing examination.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YOUTHTYPING, ITS FOUNDERS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SOFTWARE LICENSE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless YouthTyping, its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (i) your use and access of the Service, by you or any person using your account and password; (ii) a breach of these Terms; or (iii) your violation of any third-party rights, including without limitation any intellectual property right, property, or privacy right.

14. Modifications to the Service and Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

15. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in effect. Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in India.

16. Severability and Waiver

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and YouthTyping's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

17. Force Majeure

YouthTyping shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation, severe weather, natural disasters, acts of God, strikes, or governmental decrees.
